Better Human App (“us”, “we”, or “our”) operates https://www.betterhumanapp.com (the “Site”) and the Better Human App (the “App”). Through the Site and the App, we provide certain services related to food tracking and nutrition, workouts, and fitness (the “Services”). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of our Site, Services or App.

We use your Personal Information for providing and improving the Site and App. By using the Site, Services or the App, you agree to the collection and use of information in accordance with this Privacy Policy. Your use of our Site, Services, or App, and any dispute over privacy, is subject to this Privacy Policy and our Terms and Conditions, including its applicable limitations on damages and the resolution of disputes. BetterHuman’s Terms and Conditions are incorporated by reference into this Privacy Policy.

Information, Collection, and Use

In order to use the most pertinent features of our Services, we require registration and/or account creation to access these features of our Site and App. While registering to use or create an account with our Site or App, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name, address, contact information (including email and phone number), certain personal characteristics such as height and weight, and payment information (“Personal Information”). Registered users may control certain privacy settings on our Site or App, for example, you may allow for notifications, location data, and other defaults in your settings. As a default, your full profile (your “Profile Information”) is not available to any other visitors to our Site, or to other users of our App.

Log Data

Like many site operators, we collect information that your browser sends whenever you visit our Site or use our Services or App (“Log Data”). This Log Data may include information such as your phone or computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site or App that you visit, the time and date of your visit, the time spent on those pages and other statistics.

Third Party Analytics

We use automated devices and applications to evaluate usage of our Site. We also may use other analytic means to evaluate our App or Services. For example, we may use third party services such as Google Analytics that collect, monitor and analyze Log Data. We use these tools to help us improve our App, Site, Services, performance and user experiences. We may combine this information with other information we collect from our users.

Do Not Track

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Third-Party Ad Network section.

Communications

We may use your Personal Information to contact you and provide you with newsletters, marketing or promotional materials and other information that you have agreed that we may provide to you.

User-Generated Content

Our Services allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post, and Better Human App reserves the right to use any content for advertising, marketing, or any promotional or content-related purpose. Our Site is a forum for users to share their experience with Services. To this end, we invite registered users to post reviews and their custom workouts on our Site. Please note, however, that if you post any material to our Site, then all of the information that you post will be attributed to, depending on your privacy settings, either your Profile Information or your Demographic Profile. If you share your Profile Information, your identity may be visible to others unless you change your privacy settings. Further, if you post your own content on our Site or Services, your posting may become public and we are cannot prevent such information from being used in a manner that may violate this Privacy Policy, the law, or your personal privacy. You are responsible for the accuracy of any information contained in your postings.

Third-Party Ad Networks

We use third parties such as network advertisers to serve advertisements on our Site and on third-party websites or other media (e.g., social networking platforms). This enables us and these third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs) and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Our Site and Services may contain links to third-party websites. For example, occasionally, at our discretion, we may include or offer third party products or services on our Site. How We Use Your Information

We use your information, including your personal information (collectively “information”) for the following purposes:

· To provide our services to you, to communicate with you about your use of our App, to respond to your inquiries, and for other customer service purposes, which may include communicating with you via email.

· To tailor the content and information that we may send or display to you, personalized help and instructions, and to otherwise personalize your experiences while using the Site or the App.

Service Providers.

Gyms and Trainers.

With your permission and consent, you may register your gym, trainers, other similar third parties on the Site or App. They, in turn, may provide you with workouts, tips, or other information.

We also may share your information with the following persons and for the following purposes:

  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
  • In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect Us and Others. If we become aware or are informed by a parent or guardian that we have inadvertently collected personally identifiable information from a child under the age of 13, we will immediately take reasonable steps to delete such information from our public website(s) and database.

The security of your Personal Information is important to us; however, please remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Special Notice to California Consumers

California residents may request, free of charge, a list of what personal information (if any) we provided to third parties in the preceding year for that third party’s direct marketing purposes. You may make one request per calendar year. In your request, please attest that you are a California resident and provide a current California address for your response. Changes to This Privacy Policy

This Privacy Policy is effective as of 03/19/2019 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Site, Services or App after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
